Deputy Senior District Judge Arbuthnot discharges in extradition proceedings under Article 8 in Poland v. Jaroszewska.
On 11 November 2013, District Judge Arbuthnot discharged the Requested Person on extradition proceedings after finding that ordering her extradition to serve a one year custodial sentence for theft committed in 1996 would be a disproportionate interference with her and her family’s Article 8 rights; the Requested Person having moved to the United Kingdom in 1999. Benjamin Burge appeared on behalf of the Requested Person and was instructed by Sharon Toor of Virdee Solicitors.
