Rebecca Hill, together with Mike Evans at Kaim Todner have secured a Requested Person’s discharge despite being instructed only after his appeal had been dismissed. The Appellant’s return was sought to face trial in Argentina for drugs offences however his challenge to extradition had failed in both the Magistrates and High Court. An application was made to re-open the original appeal and additionally, for leave to make an out-of-time human rights appeal under the new amendments to s108 of the Extradition Act 2003 (the first of its kind). Before judgment could be given on the application the Argentinean authorities consented to the appeal being allowed and the Defendant was discharged.
