Allister Walker secured a conviction for Criminal Damage against Fathers 4 Justice protester Tim Haries after he defaced a portrait of the Queen on show at Westminster Abbey with purple spray paint. Mr Haries argued that he was not guilty of the offence as he had a right under the Human Rights Act 1998 to damage the portrait, which cost £7300 to repair. It was successfully argued in reply that this did not provide him with the defence of lawful excuse.
