Mark Smith secured a second discharge for the same client on a Slovakian extradition request. Mark successfully resisted the previous request made in 2018 due to lack of clarity about retrial rights. This time the Requested Person was discharged on the reissued warrant not only because of retrial issues but also under Article 8. The delay in reissuing the warrant was a key factor, and the Requested Person was also putting himself forward as a potential carer for his nephew currently the subject of care proceedings in the Family Court.
