Charlotte Oliver led by Richard Thomas KC (Doughty Street) appeared for Ashari Mohamed at both the preliminary ruling and appeal in what have become known as the “small boats” cases (R v Mohamed and others [2023] EWCA Crim 211 ). The appeal is the first legal challenge of its kind against the prosecution of persons under sections 24(D1) and 25(1) of the Immigration Act 1971, as amended by the 2022 Nationality and Borders Act.
