Sian Priory secures discharge in Slovakian Extradition case on issue of proportionality

The client’s extradition was sought by Slovakia in order to prosecute him for offences of Possession of Class A drugs. Sian successfully argued that whilst the offence was not covered by the guidance at 12.2 of the Criminal Practice Directions, it would be nonetheless disproportionate, pursuant to section 21A of the Extradition Act 2003, to order extradition taking into account the likely sentence,  and notwithstanding that Slovakia indicated a maximum available sentence of three years imprisonment.
