Gemma Lindfield features on BBC Radio 4's Woman's Hour. Here she discusses a recent stealthing conviction: the practice of removing one's condom during sex without the knowledge and consent of one's partner, frequently regarded as sexual assault or rape.
Whilst it is not explicitly defined by the law, the Sexual Offences Act states that if the defendant intentionally deceives their partner, then there cannot be consent.
Gemma then goes on to discuss the low conviction rate as it can be difficult to prove, with Scotland only convicting for the first time in 2023.
