First application granted for permission to appeal out of time.
Dragos Iacob v Courthouse of Bacau Romania
On 28th October 2015, Mr Justice Ouseley granted the first application for permission to appeal out of time. Dragos Iacob was unrepresented at the lower court and was given the wrong appeal form following his extradition hearing. The form was sealed by the court office but the police subsequently sought to remove him. Natasha Draycott, instructed by Mr. Chirag Patel (Head of Extradition at Macmillan Williams Solicitors), argued that they had acted expeditiously in serving the correct appeal form and that Mr Iacob did everything reasonably possible to ensure that the notice was served.
Mr Justice Ouesley emphasised the importance of complying with the guidelines in Szegfu but found that both parties had done everything that they reasonably could.
