Jose Olivares-Chandler was defence counsel in a multi-handed rape case where the CPS had reinstated a prosecution after taking no further action following the complainants' appeal of that decision via the Victims' Right to Review Scheme.
In advance of the trial, Jose had submitted a joint s8 CPIA application for disclosure which resulted in court orders with which the Crown had failed to comply and subsequently an abuse of process skeleton argument arguing that the defendant could not have a fair trial and that it was unfair to try him.
On the first day of the trial, as a result of Jose’s application and skeleton argument, the Crown reviewed the case and decided to offer no evidence on all counts.
At the end of the hearing, the trial judge praised defence counsel for their conduct in the case and, in particular, for the skeleton argument on abuse of process.
